CRIMINALIDADE E DIREITO: DIÁLOGO ENTRE A EVOLUÇÃO DO SISTEMA PUNITIVO E A MENTALIDADE SOCIAL.

Émile Durkheim, em seu As Formas Elementares da Vida Religiosa, cita como o pilar da filosofia e da religião budista as Quatro Nobres Verdades – um referencial teórico que permeia o desenvolvimento de todas as principais tradições de pensamento budistas. Neste artigo, nosso objetivo é apresentar linhas gerais e introdutórias sobre esse conceito tendo como linha narrativa o texto de Durkheim – trazendo, também, discussões sobre os contextos onde Durkheim escreveu e contrapondo outras abordagens teóricas.

O budismo é a quarta maior religião do mundo, reunindo cerca de meio bilhão de seguidores. No Brasil, por outro lado, esta religião representa uma parcela muito pequena da população, cerca de apenas 0,13%, num total de 245 mil budistas. Contudo existe uma ilusão de que há um crescimento do budismo no Brasil, pois tem ocorrido um despertar pela indústria do bem-estar, em especial em meditações mindfullness, workshops e imersões de meditações, páginas de jornais e revistas tratam sobre este assunto. (...) Mas este despertar pelo orientalismo não se reflete no número de seguidores do budismo no Brasil. Se compararmos o crescimento do budismo ao longo do CENSO com o crescimento da população brasileira no mesmo período, veremos que o budismo não cresceu na mesma proporção, o que representa um decréscimo na proporção da população do número de adeptos. Para compor o presente ensaio foi realizada revisão bibliográfica, análise dos dados históricos do CENSO e análise crítica da situação. (shrink)

Background Q-CEP (Qualificação dos Comitês de Ética em Pesquisa que compõem o Sistema CEP/Conep) is a nationwide project resulting from a partnership between the Brazilian National Research Ethics Commission (Conep), the Ministry of Health and Hospital Moinhos de Vento (HMV). It was developed to consolidate policy for ethical review of research with human beings in all members of the CEP/Conep System, Brazil’s national system of institutional review boards. The aim of this study was therefore to report on the experience and (...) results of the Q-CEP project. Methods An observational, retrospective study includes data from the Q-CEP, obtained from visits to all the institutional research ethics committees (RECs) in the country. The actions implemented by Q-CEP were part of a two-step process: (i) training visits to each REC; (ii) development of distance learning modules on strategic topics pertaining to research ethics evaluation. The data presented herein cover step one (training visits), defined by Q-CEP as the diagnostic stage of the project. For a country with social and economics inequalities such as Brazil, this is a particularly important stage; an accurate picture of reality is needed to inform planning of quality improvement strategies. Results In 2019–2021, Q-CEP visited 832 RECs and trained 11,197 people. This sample covered almost all active RECs in the country; only 4 (0.5%) were not evaluated. Of the 94 items evaluated, 62% did not reach the target of at least 80% compliance and around 1/4 (26%) were below 50% compliance. The diagnostic stage of the process revealed inadequacies on the part of the RECs in their ethical reviews. The analysis of informed consent forms showed compliance in only 131 RECs (15.74%). The description of pending issues made by RECs in their reports was compliant in 19.33% (n = 161). Administrative and operational aspects were also considered inadequate by more than half of the RECs. Conclusions Overall, Brazilian RECs showed poor compliance in several aspects of their operation, both in ethics evaluation and in other processes, which justifies additional training. The Q-CEP project is part of a quality improvement policy promoted by the Brazilian Ministry of Health. The data obtained in the diagnostic step of the project have contributed to the qualification and consolidation of one of the world’s largest research ethics evaluation systems. (shrink)

As relações entre Brasil e França quanto às dimensões de consideração sobre o racismo são semelhantes. No Brasil o mito da democracia racial impediu a percepção das injustiças e desigualdades pautadas na dimensão racializada. Na França o mesmo acontece com o mito da Republica – igualdade, liberdade e fraternidade. Porém estas insígnias são para os franceses não negros. A psicologia brasileira e a produção em saúde mental na França possuem suas diferenças. No Brasil o alheamento dos psicólogos (...) na dimensão das relações étnicas é emblemático em pleno século 21. Na França, as discussões de Lacan sobre a psicanalise promoveram a expansão do campo psicológico a desbravar a dimensão étnica considerando Frantz Fanon e outros na compreensão do sofrimento psíquico e as relações étnicas na contemporaneidade. Neste mundo globalizado, com fluxos migratórios constantes, a discussão étnica é pauta primeira para a contemporaneidade. Lembrando que as populações negras, neste contexto, são as mais violentadas. Seja na Europa, nas Américas e na África, as experiências da vivência da diáspora africana trazem experiências importantes para serem compartilhadas. Abordar parte destas imbricações e reflexões sobre os avanços e limites da psicologia no Brasil e na França no campo das relações étnicas e as relações com a atualidade nacional e global é o objetivo deste texto. The main objective of this work is to discuss the materiality of relationships and experiences of infants in early childhood education, based on a dialogue with the Brazilian curriculum guidelines for Early Childhood Education in 3 municipalities in the state of São Paulo, and with the concepts of technical objects and individuation developed by Simondon. This is a qualitative research that uses bibliographic and documentary research as a methodology and the production of cartographies of scenes in which relationships between babies (...) and objects are observed. The cartography used here is inspired by the records developed by Fernand Deligny (2015) and its appropriation for research with babies, as proposed by Julia Oliveira (2016). Research was carried out on this topic in the field of education, going through scientific articles and guiding documents for early childhood education. The authors mapped the paths and affections of babies and their relationships with objects in two distinct scenes that were collected within the scope of a collective project. It is a work that contributes to early childhood education in general and, specifically, to baby studies (Infantology, Babyhood studies). (shrink)

A reflexao busca estabelecer um eixo de consideraçao sobre a realidade do nordeste brasileiro com as perspectivas da epistemologia da Terapia Comunitaria criada pelo professor e médico psiquiatra Adalberto Barreto, e consideraçoes da pedagogia de Paulo Freire a fim de exercer o cuidado em saude mental para (...) pessoas expostas a extremas violências de ordem étnica, cultural, psiquica, econômica, social e moral. O relato revela que os conhecimentos e experiência brasileira estao sendo aprofundados e desenvolvidos por profissionais da saude mental no contexto francês através da clinica da antropologia médica, junto ao Polo de Pesquisa Médica Psicologica Associaçao Minkoviska em Paris com apoio do Ministerio da Saude da França. The social epistemology of science would benefit from paying more attention to the nature of argumentative exchanges. Argumentation is not only a cognitive activity but a collaborative social activity whose functioning needs to be understood from a psychological and communicative perspective. Thus far, social and organizational psychology has been used to discuss how social diversity affects group deliberation by changing the mindset of the participants. Argumentative exchanges have comparable effects, but they depend on cognitive diversity and emerge through critical interaction. (...) An example of a cognitive psychological theory is discussed that explains how mutual reasoning affects how we think, make decisions, and solve problems, as well as how cognitive biases may facilitate an efficient division of cognitive labor. These observations are compared with the existing results in the social epistemology of science. Moreover, I explicate the conceptual differences between the distributed and social processing of information. While argumentative exchanges belong to the latter domain, most existing simulations model distributed processing, which may compromise their real-world relevance and proper conceptual interpretation. However, I aim not to criticize the existing simulation methods but to promote an approach from the cognitive psychology of reasoning that complements the current use of organizational psychology and computer simulations by investigating a different set of mechanisms relating to similar phenomena of interest in the social epistemology of science. Kant’s dualism in anthropology and morality is said to be bridged only by means of a teleology that seems to betray the historical constitution of its subjectivity. And yet the Kantianarticulation of problems of theoretical and practical reason can be explored only insofar as they help us understand the correlated issues of the unity of reason, the relation of aesthetics and ethics in the light of the three Critiques, and the teleological conception of history. In this paper, I argue for (...) a teleological reading of the systematic architectonic so as to make sense of the concept of purposiveness as the a priori principle of judgment in its logical, aesthetic, and teleological reflection and of the unifying, a priori principles of each faculty–namely, conformity to law, final purpose, and conformity to purpose or purposiveness – respectively dealt with in the three Critiques. The need for the political empowerment of women, and the role played by the media in both promoting and hindering it are well-known problems. A new opportunity to consider these problems as regards the Italian case was afforded by the 1999 presidential election. During that selection process, the proposal to appoint a woman as head of the nation was, for the first time, brought into the arena for debate. Neither of the two women who were candidates – European Commissioner Emma (...) Bonino and Minister of the Interior Rosa Russo Jervolino – were elected. Using the `public arenas model' and the concept of `framing', the article explores the rise and fall of the two female candidatures by highlighting the limits in the social construction of the women's agenda. Considered from this point of view, the campaign offers an interesting case study in order to better understand the mechanisms of gender exclusion. (shrink)

The text delivers a twofold analysis of negationism. On the one hand, it is taken as an ideological phenomenon characterized by a critique of modernity construed from the outside of its customary assumptions. On the other hand, an objective sort of negationism is found in the historical unfolding of the intrinsic limitations of modern socialization. These are brought forward by attention to the class content of the class character of the institutions regularly evoked by the apologetics of modernity – civil (...) society, science, the State. Progressivism, we suggest, the main target of negationism, is the tradition occupied with that apologetics, either promoting an intellectual critique of, or simply overlooking, the afore-mentioned class character, which, however, becomes historically undeniable to the common people, consistently victimized by it throughout modern history. In this sense, the modern social process is characterized as civil war. (shrink)

Käsitteellinen ymmärtäminen pohjautuu kykyyn käyttää ympäristömme säännönmukaisuuksia koskevaa tietoa päämääriemme suhteen mielekkäillä tavoilla, ja tämä koskee myös sosiaalista tietoa sanojen ja symbolien tarkoituksenmukaisesta käyttämisestä. Näin ollen käsitteitä, ymmärtämistä ja järkeilyä tulisi psykologisesti tarkastella ensisijaisesti taitamiseen eikä tietämiseen liittyvänä ilmiönä.

Cancer derives from a cell clone that has accumulated genetic and epigenetic changes that influence its phenotype and finally enable it to escape from the normal controls of proliferation. A recent paper shows that, in myc‐induced tumours, the inactivation of this oncogene produces the regression of the tumours and the differentiation of the tumour cells into mature osteocytes.1 In addition, a further reactivation of myc in these cells does not restore the malignant phenotype but induces apoptosis. The history of science can be better understood against the background of a history of knowledge comprising not only theoretical but also intuitive and practical knowledge. This widening of scope necessitates a more concise definition of the concept of knowledge, relating its cognitive to its material and social dimensions. The history of knowledge comprises the history of institutions in which knowledge is produced and transmitted. This is an essential but hitherto neglected aspect of cultural evolution. Taking this aspect into account (...) one is led to the concept of extended evolution, which integrates the perspectives of niche construction and complex regulative networks. A two stage model was developed and tested to explain how ethical leadership relates to followers’ ethical judgment in an organizational context. Drawing on social learning theory, ethical leadership was hypothesized to promote followers’ self-leadership focused on ethics. It was found that followers’ perceived accountability fully accounts for this relationship. In stage two, the relationship between self-leadership focused on ethics and moral judgment in a dual decision-making system was described and tested. Self-leadership focused on ethics was only related to moral (...) judgment when followers use active judgment as opposed to their intuition. This provides support that a deliberate application of self-leadership focused on ethics leads to higher moral judgment. Theoretical and practical implications as well as future research opportunities are discussed. (shrink)

The history of the theory of general relativity presents unique features. After its discovery, the theory was immediately confirmed and rapidly changed established notions of space and time. The further implications of general relativity, however, remained largely unexplored until the mid 1950s, when it came into focus as a physical theory and gradually returned to the mainstream of physics. This essay presents a historiographical framework for assessing the history of general relativity by taking into account in an integrated narrative intellectual (...) developments, epistemological problems, and technological advances; the characteristics of post–World War II and Cold War science; and newly emerging institutional settings. It argues that such a framework can help us understand this renaissance of general relativity as a result of two main factors: the recognition of the untapped potential of general relativity and an explicit effort at community building, which allowed this formerly disparate and dispersed field to benefit from the postwar changes in the scientific landscape. Introduction: Motherese, or emotional infant directed speech, is the specific form of speech used by parents to address their infants. The prosody of IDS has affective properties, expresses caregiver involvement, is a marker of caregiver-infant interaction quality. IDS prosodic characteristics can be detected with automatic analysis. We aimed to explore whether pregnant women “speak” to their unborn baby, whether they use motherese while speaking and whether anxio-depressive or obstetrical status impacts speaking to the fetus.Participants and Methods: We conducted an observational (...) study of pregnant women with gestational ages from 26 to 38 weeks. Women were recruited in a university hospital department of obstetrics. Thirty-five women agreed to participate in the study, and 26 audio records were exploitable. We collected obstetrical and sociodemographic data, pregnancy outcomes, anxiety and depressive status using the Covy and Raskin Scales, and life events using the Sensations During Pregnancy and Life Event Questionnaire. Each participant was left alone with an audio recorder with a recommendation to feel free to speak to her fetus as she would have done at home. The recording was stopped after 3 min. Audio recordings were analyzed by two methods: psycholinguist experts' annotation and computational objective automatic analyses.Results: Most mothers reported speaking to their fetuses. We found a correlation between maternal first perceptions of fetal movements and the start of mother's speaking to fetus. Motherese prosody was detected with both annotation and automatic analysis with a significant correlation between the two methods. In this exploratory study, motherese use was not associated with maternal anxiodepressive or obstetrical status. However, the more future mothers were depressed, the less they spoke with their fetuses during the recording.Conclusion: Fetal directed speech can be detected during pregnancy, and it contains a period of prosody that shares the same characteristics of motherese that can be described as prenatal motherese or emotional fetal-directed speech. This means that pregnant women start using motherese much earlier than expected. FDS seems to be correlated with maternal first perceptions of fetal movements and depression scores. Ce livre propose d'aborder la pensée de Charles Taylor par ce qu'il reconnaît être son centre de cohérence : "l'horizon moral de signification". D'entrée de jeu, il situe assez clairement Taylor dans le vaste horizon de la philosophie morale contemporaine. Le texte pose bien l'originalité de la conception taylorienne de l'ontologie ; ses idées d'incarnations, d'engagement et la relation incontournable du moi. Sans complaisance, il montre le rôle central que joue cet horizon dans la philosophie morale taylorienne tout en exposant (...) les zones d'ombre où Taylor est moins clair ou moins explicite dans sa pensée. En illustrant clairement le lien entre l'horizon moral et l'identité d'une part, et celui entre les horizons et le dialogue interculturel d'autre part, le livre enrichit les analyses existantes sur le sujet. Il expose le dilemme taylorien entre contexte et universalisme. L'originalité de Taylor réside dans la manière dont il repose ce dilemme conservant en tension ces deux axes; orienter sa vie en fonction du bien nous oblige à naviguer entre deux eaux. La question du dialogue interculturel est naturellement incontournable dans le présent débat avec Taylor. Les considérations sur le "langage des contrastes" et le passage par les écrits de Raoul Fornet-Betancourt sont tout à fait pertinents. En effet, l'interculturalité ou le dialogue interculturel appelle un nouveau langage, mais les conditions de celui-ci? et son statut ontologique d'ailleurs ne sont pas clairement exprimées dans les écrits tayloriens. Et ils peuvent difficilement l'être, car cela demeure pour lui de l'ordre du mystère et du dévoilement. We present Dynamic Epistemic Temporal Logic, a framework for reasoning about operations on multi-agent Kripke models that contain a designated temporal relation. These operations are natural extensions of the well-known “action models” from Dynamic Epistemic Logic. Our “temporal action models” may be used to define a number of informational actions that can modify the “objective” temporal structure of a model along with the agents’ basic and higher-order knowledge and beliefs about this structure, including their beliefs about the time. In essence, (...) this approach provides one way to extend the domain of action model-style operations from atemporal Kripke models to temporal Kripke models in a manner that allows actions to control the flow of time. We present a number of examples to illustrate the subtleties involved in interpreting the effects of our extended action models on temporal Kripke models. We also study preservation of important epistemic-temporal properties of temporal Kripke models under temporal action model-induced operations, provide complete axiomatizations for two theories of temporal action models, and connect our approach with previous work on time in DEL. We present a complete, decidable logic for reasoning about a notion of completely trustworthy evidence and its relations to justifiable belief and knowledge, as well as to their explicit justifications. This logic makes use of a number of evidence-related notions such as availability, admissibility, and “goodness” of a piece of evidence, and is based on an innovative modification of the Fitting semantics for Artemovʼs Justification Logic designed to preempt Gettier-type counterexamples. We combine this with ideas from belief revision and awareness (...) logics to provide an account for explicitly justified knowledge based on conclusive evidence that addresses the problem of omniscience. Thomas Kuhn's philosophy of science, which he developed by focusing on physics, was later applied by other authors to virtually all areas or disciplines of culture. What interests me here, however, is the movement in the opposite direction: the role that one of these disciplines, history of art, played in the conception of Kuhn'stheoryof science.In a 1969 article, his only published text concerning science and art, Kuhn makes a brief and intriguing observation about The Structure of Scientific Revolutions. The articles collected in this volume have their origin in an international workshop dedicated to “Experience and Knowledge Structures in Arabic and Latin Sciences.” Specialists from Great Britain, France, Denmark, Spain, Morocco, the United States, and Germany gathered in Berlin in 1996 in the context of an interdisciplinary research project on the history of mechanical thinking at the Max Planck Institute for the History of Science. The workshop initiated a process of discussion focused on problems of the intercultural transmission and (...) transformation of knowledge. The ArgumentIn this paper I present and argue for a model of conceptual development in science and apply it to the transition from classical to modern physics associated with Einstein. The model claims a continuous and rational transition between incompatible subsequent conceptual systems in mathematical science and explains its mechanism. The model was developed in a study of the transition from preclassical to classical mechanics. I argue for a strong structural analogy between the transition from preclassical to classical mechanics on (...) the one hand and from classical to modern physics on the other. The first transition is briefly sketched here by reference to Galileo and his disciples; in the second transition Planck and Lorentz on the one hand and Einstein on the other play the respective roles.A detailed and documented reconstruction of the transition from preclassical to classical mechanics on the basis of this model has already been published and is only briefly referred to in the paper. The transition from classical to modern physics is portrayed here much more extensively—though of course merely in broad brush strokes. Einstein–s role in this transition is reconstructed in the light of a conceptualization of his scientific knowledge as an active structure of thought, shaped by his intellectual experience. In this way, the development of his individual thinking is shown to be part of the overall process of conceptual transformation from classical to modern physics. The reconstruction sketched in this paper is to be considered as a proposal to be substantiated, reformed, and improved by future detailed studies. (shrink)

Jürgen Renn examines the role of knowledge in global transformations going back to the dawn of civilization while providing vital perspectives on the complex challenges confronting us today in the Anthropocene--this new geological epoch shaped by humankind. Renn reframes the history of science and technology within a much broader history of knowledge, analyzing key episodes such as the evolution of writing, the emergence of science in the ancient world, the Scientific Revolution of early modernity, the globalization of knowledge, industrialization, and (...) the profound transformations wrought by modern science. He investigates the evolution of knowledge using an array of disciplines and methods, from cognitive science and experimental psychology to earth science and evolutionary biology. The result is an entirely new framework for understanding structural changes in systems of knowledge--and a bold new approach to the history and philosophy of science. (shrink)

The objective of this work is to reconstruct the concepts of constellation, parataxis and essay, from the perspective of Theodor Adorno, in order to approach them by affinity, but demonstrating the way that each one expresses within its specificities the Adorno’s insistence in a model of thought in which the non-identical: 1) resists conceptual subsumption by arranging itself in a constellatory configuration; 2) it does not succumb to subordinate juxtapositions typical of merely communicative language; and, 3) finds its best philosophical (...) expression in the essay form. In order to do so, we will take as a starting point the adornian reconstruction of the constellation category as a legacy of Walter Benjamin’s thought, so that later we can present the expansion of this category in Adorno’s thought, relating it both to the conception of parataxis as in the conception of the essay form, but aiming to understand these categories as way of thinking philosophically aiming to elucidate the place of the non-identical in the scope of dialectical thinking of Theodor Adorno. Internal misconduct is a universal problem in prisons and affects the maintenance of social order. Consequently, correctional institutions often develop rehabilitation programs to reduce the likelihood of inmates committing internal offenses and criminal recidivism after release. Therefore, it is necessary to identify the profile of each offender, both for the appropriate indication of a rehabilitation program and the level of internal security to which he must be submitted. In this context, this work aims to discover the most significant characteristics in (...) predicting inmate misconduct from ML methods and the SHAP approach. A database produced in 2004 through the Survey of Inmates in State and Federal Correctional Facilities in the United States of America was used, which provides nationally representative data on prisoners from state and federal facilities. The predictive model based on Random Forest performed the best, thus, we applied the SHAP to it. Overall, the results showed that features related to victimization, type of crime committed, age and age at first arrest, history of association with criminal groups, education, and drug and alcohol use are most relevant in predicting internal misconduct. Thus, it is expected to contribute to the prior classification of an inmate on time, to use programs and practices that aim to improve the lives of offenders, their reintegration into society, and consequently, the reduction of criminal recidivism. We present Arrow Update Logic, a theory of epistemic access elimination that can be used to reason about multi-agent belief change. While the belief-changing of Arrow Update Logic can be transformed into equivalent belief-changing from the popular Dynamic Epistemic Logic approach, we prove that arrow updates are sometimes exponentially more succinct than action models.
